Comment before the June 29 deadline: Tell the EPA you oppose eliminating the Air Nuisance Rule!
The Trump Administration is trying to take away a critical tool communities in Ohio use to hold big polluters accountable. We must take action to protect it!
Ohio’s Air Nuisance Rule (ANR) is a provision of Ohio’s federal state implementation plan (SIP) of the Clean Air Act. This rule has been in place for decades and gives residents the ability to go to court to address pollution in their communities, with polluters footing the legal bill. In 2020, the first Trump Administration tried to scrap the ANR but we took them to court and after many years of fighting, we succeeded in defending the rule and keeping it in place, with the Biden Administration finalizing its reinstatement right before the change in power.
In 2025, the Ohio Legislature quietly added an amendment to an unrelated bill that was quickly passed and signed into law to try to repeal the ANR. Ohio Environmental Council joined with allies and sued arguing this move was unconstitutional but now, while that litigation is still pending, the USEPA—now led by Trump Administration appointees—is moving to finalize the repeal of this critically important tool.
TAKE ACTION: Send a message to the US EPA and tell them you oppose their efforts to take this critical protection tool away from Ohioans!
For years, big polluters and their allies have fought to take away the ANR from Ohioans precisely because they know we, the public, can use it to hold those polluters accountable. Ohio Environmental Council’s members and supporters always step up to fight these corrupt efforts and it’s time for us to do that again.
Tell the US EPA that:
- It shouldn’t remove the Air Nuisance Rule because it is an essential protection for Ohio’s environmental justice communities
- The Ohio EPA asked for the removal based on an unconstitutional mandate from the Ohio General Assembly
- The US EPA shouldn’t make a final decision until litigation over the legislative mandate to remove the Air Nuisance Rule concludes
